The US Environmental Protection Agency has proposed scrapping a decades-old requirement under the 1970 Clean Air Act that mandates a minimum 30-day public comment period before construction of new industrial facilities classified as "minor sources" of air pollution — a category that includes data centers and steel mills. If finalized, the change would allow tech companies to begin building data centers before neighboring communities are notified, let alone able to voice opposition. The EPA framed the proposal as reducing administrative burden and speeding up permitting, saying it would put "state and local agencies in the driver's seat." Critics call it a move to silence growing community resistance to data center construction. A letter opposing the proposal was signed by attorneys general from over a dozen states and three cities. Nearly 200 advocacy groups also filed opposition. Data centers are individually classified as minor pollution sources, but the 60 largest currently under construction will collectively emit approximately 101.5 million tons of CO₂ annually, according to a Financial Times analysis. Trump has publicly dismissed community opposition to data centers as misinformed and previously suggested it may be the result of foreign influence operations.
