A mistrial in the Lindsay Clancy case has sparked a national firestorm, and Rep. Nancy Mace is not holding back.
After jurors in Massachusetts remained deadlocked, Mace reacted publicly with a blunt statement: “Lindsay Clancy deserves the same mercy she showed her children: none.” She had also argued that if postpartum mental illness becomes a “get-out-of-jail-free card” for m*rdering children, then people diagnosed with it would logically face questions about custody.
Clancy, 36, was charged after the January 2023 d*aths of her three children, Cora, 5, Dawson, 3, and Callan, 8 months, inside their Duxbury, Massachusetts home. She has never denied causing their d*aths. Afterward, she suffered injuries that left her paralyzed from the waist down.
The central issue at trial was not whether Clancy caused the d*aths, but whether she was criminally responsible at the time. Her defense argued she was suffering from postpartum psychosis and documented postpartum mental health struggles. Prosecutors acknowledged mental-health issues but argued she understood her actions and planned them.
After nearly six weeks of testimony and almost 40 hours of deliberation, the jury could not reach a unanimous verdict, and a mistrial was declared on September 4. Clancy remains charged with three counts of first-degree m*rder and remains in state custody at a hospital. Prosecutors have not yet announced whether they will retry her, with another hearing scheduled for September 29.
The case has opened a difficult public conversation about postpartum psychosis, criminal responsibility, parental safety, and how courts weigh severe mental illness in violent cases.
