PSCBC Bargaining Council The PSCBC is an independent organisation established in terms of Section 35 of the Labour Relations Act 66 of 1995 (LRA), read with Sections 36 and 37.

The main objective of the organisation is to maintain good labour relations in the Public Service.

As we concluded today’s workshop, the Deputy Chairperson of the Essential Services Committee Ms Joyce Nkopane, delivered a robust presentation on the intricate challenges that often leave Minimum Service Agreements and essential services mandates at a standstill. The floor was then opened for open discussion, allowing all parties to engage meaningfully.

The ESC plays a pivotal role in determining which services are essential and ratifying MSAs under Section 72 of the Labour Relations Act. Common bottlenecks include disagreements over which workers constitute the minimum service, conflicting interpretations of agreements, and delays in ratification. When parties fail to conclude an MSA, an ESC panel can impose the minimum service required. Crucially, workers in essential services cannot strike unless an MSA is in place.

The Essential Services Committee workshop hosted by the PSCBC is currently underway. The session was opened by PSCBC General Secretary Mr Frikkie De Bruin, who delivered a welcome address and acknowledged all stakeholders present.

Ms Grace Mafa -Chali, Chairperson of the ESC, delivered a rigorous presentation. She began with a preamble outlining the functions of the ESC and explained the constitutional right of employees’ right to strike, including the limitations prescribed by law. She further emphasised the importance of parties in concluding a minimum service agreement, which enables employees to exercise their right to strike while ensuring that essential services remain protected.

As we mark the 50th Golden Jubilee of the 1976 Soweto Uprising, the PSCBC honours the courage and sacrifice that fuelled generations of activism and recommits to fair labour practices, skills development and inclusive participation for young public servants. As part of its ongoing Corporate Social Responsibility programme with Bombani Shelter in Alexandra, the PSCBC has expanded its support to include mental health and wellness initiatives for women affected by gender-based violence. Led by ICT Manager Oomang Parag in his capacity as a yoga instructor, the programme offers yoga and wellness sessions aimed at promoting healing, inner strength, and emotional well-being. Through this initiative, the PSCBC continues to champion dignity, care, and holistic support for vulnerable women in our communities.
